New Uncertainty in Global Trade

The Supreme Court’s tariff ruling (2/20/26) is a major setback for President Trump, who lashed out at the justices who ruled against him, and raised questions about the trade deals his administration has struck with countries around the world.  The ruling causes new uncertainty in global trade. Moreover, it undercuts the centerpiece of the president’s economic agenda.

The court, in a 6-3 decision written by Chief Justice John G. Roberts Jr., ruled that Mr. Trump had exceeded his authority when he imposed tariffs on nearly every U.S. trading partner last year. The ruling prompted a defiant response from the president: In a news conference at the White House, he vowed to restore tariffs using other authority and excoriated the justices who had ruled against him as “fools and lap dogs.”  Interesting choice of words by Trump – perhaps some self-reflection needed there.

ST&R’s advice to importers continues to be that there is no need to file suit now before liquidations occur to preserve their rights to potential IEEPA tariff refunds. In addition, because it is still uncertain whether protests will ultimately be required and whether U.S. Customs and Border Protection will refund IEEPA tariffs through protests without the need for litigation, we still advise importers to protest liquidations to ensure the availability of refunds.
